Until now it was not possible to retain enjoyment rights over gifted property. Yesterday, 27.08.2026, "Transfer of Property (Amendment) Act, 2026" Bill, was introduced in the Bangladesh Parliament, to establish a legal framework for gifting property while formally retaining lifetime enjoyment rights.
The bill aims to amend the Transfer of Property Act, 1882 by introducing newly proposed Sections 122A and 122B.
According to this bill, individuals can legally gift movable or immovable property while legally reserving the right of lifetime usufruct(a legal right that allows a person to use and enjoy someone else's property temporarily without owning it), meaning the donor retains the right to use and enjoy the property until their death.
This newly introduced type of gift will be exclusively valid between parents/grandparents and children/grandchildren (or vice versa), and between spouses.
It will be mandatory for such gift deed to be registered in order to be valid. The proposed bill also introduces the option to mutually revoke the gift instrument under certain circumstances.
However, the division of maintenance and financial liabilities between the enjoyment rights retaining donor and the title-holding donee is not expressly mentioned which may give rise to a new type of disputes. Important details has not been addressed, such as responsibility for repairs, taxes, rents, etc. Whether enjoyment rights include the right to lease the property out commercially to third parties or only to retain residential possession/enjoyment?
